Welcome to WebTap. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and WebOrbit LLC, a Florida limited liability company ("WebTap," "we," "us," or "our"), governing your access to and use of the WebTap platform at webtap.me and all related services.
By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.
1. Description of Services
WebTap provides a suite of SaaS products designed for businesses and professionals:
1.1 WebTap Business Cards
A digital business card platform that enables users to create digital profiles, order NFC-enabled physical cards, share contact information, capture leads, and manage customer networks. Business Card accounts are free to create with optional paid NFC card orders.
1.2 WebTap Realty
A real estate agent platform providing digital agent profiles, NFC cards (personal, customer, and open house cards), a full CRM system with contact management, pipeline tracking, email and SMS communication, listing management, open house check-in tools, and document sharing.
1.3 WebTap Reviews
A review management platform that enables businesses to collect customer reviews, route positive reviews to Google, capture negative feedback privately, manage team member review links, track analytics, and optionally upgrade to Review+ Pro for advanced features.
1.4 Review+ Pro Subscription
A premium subscription tier for WebTap Reviews at $20 per month (or as otherwise listed at the time of purchase) that provides:
- Google Business Profile integration with live review monitoring
- AI-powered review reply generation
- Competitor tracking and analysis (up to 3 competitors)
- Advanced analytics and sentiment analysis
- Social media marketing post generation
- Customizable review widget with branding removal
- Priority alert notifications
- Auto-reply queue management
2. Eligibility & Account Registration
2.1 Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- You must have the legal authority to enter into these Terms.
- If you are creating an account on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2.2 Account Registration
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
- You must not share your account credentials or allow others to access your account.
- You must notify us immediately at support@webtap.me if you suspect unauthorized use of your account.
- We reserve the right to refuse registration or cancel accounts at our discretion.
2.3 Account Types
WebTap offers different account types depending on the platform:
- Business Card Accounts: Client accounts (business owners) and Customer accounts (NFC card recipients).
- Realtor Accounts: Real estate agent accounts with CRM and listing management.
- Review Accounts: Business owner accounts with optional team member sub-accounts.
3. Subscriptions & Billing
3.1 Free Tiers
WebTap Business Cards, Realty, and the base Review platform are free to use. Certain premium features require a paid subscription.
3.2 Review+ Pro Subscription
- Review+ Pro is billed monthly at $20/month through Stripe.
- New subscribers may be eligible for a 7-day free trial (one trial per account).
- Your subscription automatically renews each month unless cancelled before the renewal date.
- You will be charged on the same date each month that you initially subscribed.
3.3 Payment Processing
- All payments are processed securely through Stripe. By making a payment, you also agree to Stripe's terms of service.
- You are responsible for providing valid, up-to-date payment information.
- We reserve the right to change pricing with 30 days' advance notice. Existing subscribers will be notified of any price changes before they take effect.
3.4 Customer Subscriptions (Business Cards)
Business Card clients may offer subscription products to their customers through the WebTap platform. These subscriptions are managed through Stripe and are subject to the pricing set by the individual client.
3.5 Failed Payments
If a payment fails, we may retry the charge and/or suspend access to premium features until the payment is resolved. Continued non-payment may result in cancellation of your subscription.
4. NFC Card Products
4.1 Ordering
- NFC cards can be ordered through your dashboard after creating an account.
- Card prices, quantities, and shipping costs are displayed at the time of order.
- Orders are final once payment is processed.
4.2 Shipping
- NFC cards are shipped to the address provided during checkout.
- Standard shipping typically takes 5-10 business days within the United States.
- We are not responsible for delays caused by shipping carriers, incorrect addresses, or customs processing for international orders.
4.3 Activation
- NFC cards must be activated through the WebTap platform to link to a user profile.
- Cards are linked to your account and cannot be transferred to other accounts without authorization.
- Lost or damaged cards must be reordered; we do not provide free replacements.
4.4 Card Functionality
NFC cards work by redirecting to a WebTap-hosted page when tapped by a compatible device. Card functionality depends on the recipient's device supporting NFC technology. WebTap is not responsible for NFC compatibility issues with specific devices.
5. Acceptable Use Policy
You agree not to use our Services to:
- Violate any applicable local, state, national, or international law or regulation.
- Infringe on the intellectual property, privacy, or other rights of any third party.
- Upload, transmit, or distribute harmful content including malware, viruses, or spam.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
- Engage in fraudulent, deceptive, or misleading practices.
- Harvest, scrape, or collect information from other users without their consent.
- Interfere with or disrupt the Services, servers, or networks connected to the Services.
- Attempt to gain unauthorized access to any part of the Services, other accounts, or computer systems.
- Use the Services for any illegal activity, including money laundering or terrorist financing.
- Create fake reviews, manipulate ratings, or engage in review fraud.
- Use our AI features to generate misleading, defamatory, or harmful content.
- Resell, sublicense, or redistribute access to the Services without our written permission.
- Upload content that is obscene, threatening, harassing, defamatory, or that promotes violence or discrimination.
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without prior notice.
6. User-Generated Content
6.1 Your Content
You retain ownership of content you create and upload to WebTap, including profile information, images, review responses, business listings, and CRM data. By uploading content, you grant WebTap a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the Services.
6.2 Review Content
Reviews submitted by customers through the WebTap Review platform belong to the reviewer. Business owners have the right to view, respond to, and use review feedback for business improvement purposes. Reviews may be displayed on public-facing review pages.
6.3 AI-Generated Content
Content generated by our AI features (review replies, marketing posts, sentiment analysis) is provided as suggestions. You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing. WebTap is not liable for any consequences arising from AI-generated content that you choose to publish.
6.4 Content Removal
We reserve the right to remove any content that violates these Terms, our Acceptable Use Policy, or applicable laws, without prior notice.
7. Intellectual Property
7.1 WebTap's Intellectual Property
The WebTap platform, including its design, code, features, logos, trademarks, and documentation, is owned by WebOrbit LLC and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our written consent.
7.2 Feedback
If you provide us with feedback, suggestions, or ideas, we may use them without restriction or obligation to you.
8. Third-Party Services & APIs
Our Services integrate with and rely on third-party services including:
- Stripe — Payment processing and subscription management.
- Google APIs — Google Business Profile integration, Maps, and review management.
- Cloudinary — Image and document hosting and delivery.
- SendGrid (Twilio) — Email delivery.
- Twilio — SMS messaging for Realty CRM.
- OpenAI — AI-powered features (review replies, content generation, analysis).
Your use of these third-party services is subject to their respective terms and privacy policies. WebTap is not responsible for the availability, accuracy, or practices of third-party services. If a third-party service becomes unavailable, certain features of our platform may be temporarily affected.
9. AI-Generated Content
- AI features are provided "as is" and may produce inaccurate, inappropriate, or incomplete results.
- You must review all AI-generated content before publishing or using it.
- WebTap makes no warranties regarding the accuracy, quality, or suitability of AI-generated content.
- You are solely responsible for any consequences arising from your use of AI-generated content.
- AI features may be subject to rate limits and usage quotas.
- We reserve the right to modify or discontinue AI features at any time.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, WebTap does not warrant that:
- The Services will be uninterrupted, error-free, or secure.
- Any defects will be corrected.
- NFC cards will be compatible with all devices.
- Google review data will be accurate, complete, or up-to-date.
- AI-generated suggestions will be appropriate, accurate, or effective.
- The Services will meet your specific requirements or expectations.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEBORBIT LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(a) Your access to or use of (or inability to access or use) the Services;
(b) Any conduct or content of any third party on the Services;
(c) Any content obtained from the Services;
(d) Unauthorized access, use, or alteration of your transmissions or content;
(e) Loss of NFC cards or failure of NFC technology;
(f) AI-generated content used or published by you.
Our total aggregate liability to you for all claims arising from or related to the use of our Services shall not exceed the greater of: (a) the total amount you paid to WebTap in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless WebOrbit LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:
- Your use of the Services.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Content you upload, publish, or transmit through the Services.
- Your use or publication of AI-generated content.
13. Termination & Account Suspension
13.1 Termination by You
- You may close your account at any time by using the "Request Account Deletion" feature in your account settings or by emailing support@webtap.me.
- Active subscriptions should be cancelled before requesting account deletion to avoid further charges.
- Upon account deletion, your data will be permanently removed within 30 days, except where retention is required by law.
13.2 Termination by WebTap
- We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or our Acceptable Use Policy.
- We may suspend accounts that show signs of fraud, abuse, or unauthorized activity.
- We reserve the right to discontinue any or all of the Services with 30 days' notice to active subscribers.
13.3 Effect of Termination
- Upon termination, your right to use the Services immediately ceases.
- NFC cards linked to terminated accounts will redirect to a "not found" page.
- We are not obligated to retain or forward any data from terminated accounts, except as required by law.
- Provisions of these Terms that by their nature should survive termination will survive (including Sections 7, 10, 11, 12, and 15).
14. Refund Policy
14.1 Subscriptions
- Subscription payments are non-refundable. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.
- If you cancel during a free trial, you will not be charged.
14.2 NFC Card Orders
- NFC card orders are non-refundable once they have been shipped.
- If you receive defective cards, contact support@webtap.me within 14 days of delivery for a replacement or refund at our discretion.
- Cards damaged after delivery due to user mishandling are not eligible for refund or replacement.
14.3 Exceptional Circumstances
We may issue refunds at our sole discretion for exceptional circumstances. All refund requests should be sent to support@webtap.me.
15. Governing Law & Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.
15.2 Dispute Resolution
Any dispute arising from or relating to these Terms or the Services shall be resolved as follows:
- Informal Resolution: We encourage you to contact us first at support@webtap.me to attempt to resolve any dispute informally. We will endeavor to resolve disputes within 30 days.
- Binding Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Pinellas County, Florida, in accordance with its Commercial Arbitration Rules.
- Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
15.3 Jurisdiction
For any matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Pinellas County, Florida.
16. Modifications to Terms
- We reserve the right to modify these Terms at any time.
- Material changes will be communicated via email or in-app notification at least 30 days before they take effect.
- Your continued use of the Services after the effective date of modified Terms constitutes acceptance of the new Terms.
- If you disagree with the modified Terms, you must stop using the Services and close your account.
17. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and WebTap.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- Force Majeure: We are not liable for any failure or delay due to circumstances beyond our reasonable control, including natural disasters, acts of government, pandemics, or infrastructure failures.
- Notices: We may send notices to the email address associated with your account. Notices to us should be sent to support@webtap.me.
